When collecting phone numbers for messaging campaigns, your Privacy Policy must be easily accessible and clearly visible near the point where the consumer enters their number. Carriers rigorously check the website linked by your Brand to ensure this placement.
Crucially, your Privacy Policy must explicitly state three (3) things:
That you are collecting phone numbers as a part of personal information.
That end-user information will NOT be shared or sold to any third parties or affiliates.
This restriction includes, but isn't limited to, sharing data for marketing purposes, lead generation, or third-party analytics. In essence, the policy must clearly confirm that all end-user information is protected, encompassing even voice and political use cases.

Include a point that states that you collect contact information provided by the user in the “Personal Information We Collect” Section
Example Personal information you provide to us through the Service or otherwise includes: Business and personal contact information, such as your first and last name, email and mailing addresses, phone number, professional title and company name.
Include a point explicitly stating that end-user information will NOT be shared or sold to any third parties or affiliates in the “How We Share Your Personal Information” Section. We recommend including at minimum Example 3, ideally all.
Example 1 (no personal information sold)
Marketing and advertising We do not sell your personal information or the personal information of your users.
Example 2 (no phone number information sold)
SMS Marketing and advertising We do not sell your phone number or the phone number of your users.
Example 3 (phone numbers only shared with service providers)
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
Include an explanation of the SMS Opt Out process in the “Your Choices” Section
Example: Opt-out of text message communications. You may opt-out of text messaging at any time by replying to any message with STOP contacting us at company@email.com. This will end the communications from that particular phone number. You may continue to receive service-related and other non-marketing text messages from other phone numbers managed by Company, and you may opt out of those in a similar fashion.
